By making a booking, purchasing a service or product, or otherwise engaging with Nails By Mya Lily, you agree to these Terms & Conditions.

These Terms & Conditions are intended to provide clear expectations for both Nails By Mya Lily and its clients. Nothing in these terms is intended to exclude, restrict or modify any rights or remedies that cannot legally be excluded under Australian Consumer Law.

Nails By Mya Lily is a local, home-based nail business located in Mernda, Victoria.

The business provides personalised nail services including manicures, pedicures, Acrylic and SNS services, Builder Gel, Gel-X services, nail designs and handmade press-on nails.

Nails By Mya Lily aims to provide a friendly, personalised experience while paying close attention to the individual needs and preferences of each client.

2. Bookings & Appointments

Appointments are subject to availability and are not confirmed until Nails By Mya Lily has accepted the booking.

Clients should provide accurate information when making a booking, including their preferred service, date and time.

Clients are encouraged to communicate any important requirements, preferences, nail concerns or design requests before their appointment.

Nails By Mya Lily may contact a client before an appointment to confirm the booking or clarify the requested service.

Appointment times may vary depending on the service selected, the condition of the client's nails and the complexity of the requested design.

3. Arriving for Your Appointment

Clients are expected to arrive at their agreed appointment time.

Arriving late may reduce the amount of time available for the appointment. Where possible, Nails By Mya Lily will try to accommodate the requested service, but certain services or designs may need to be adjusted if there is insufficient time.

If a client is significantly late, Nails By Mya Lily may need to reschedule the appointment.

Any decision to reschedule or adjust a service due to lateness will be communicated to the client.

4. Cancellations & Rescheduling

If you need to cancel or reschedule an appointment, please contact Nails By Mya Lily as soon as possible.

Where possible, reasonable notice should be provided so the appointment time can be offered to another client.

Repeated cancellations, failure to attend appointments or unreasonable changes to bookings may affect the ability to make future appointments.

Nails By Mya Lily may choose to apply a booking deposit or cancellation fee in the future. If this occurs, the amount and relevant conditions will be clearly communicated before the booking is confirmed.

5. No-Shows

A client who does not attend their appointment without contacting Nails By Mya Lily may be considered a no-show.

Nails By Mya Lily may decline future bookings from clients who repeatedly fail to attend appointments without reasonable notice.

Any fees associated with missed appointments will only apply where they have been clearly communicated and agreed to in accordance with applicable law.

6. Services & Pricing

Current service prices are displayed on the Nails By Mya Lily website and may change from time to time.

Prices may vary depending on the selected service, nail length, design, additions or other requirements.

Any additional costs should be communicated to the client before the additional service or product is provided where reasonably possible.

The price of a service may differ from an initial estimate if the client requests additional services or designs.

Nails By Mya Lily reserves the right to update its pricing at any time. Price changes will not affect a booking that has already been confirmed unless the client requests changes or additional services.

7. Nail Designs & Custom Requests

Nails By Mya Lily offers a range of nail designs and customisation options.

Clients may provide inspiration images or describe a preferred design. While every effort will be made to achieve the requested result, exact replication of another artist's work, a photograph or a design may not always be possible.

Design availability may depend on the time available, materials, nail condition and the complexity of the requested design.

If a requested design requires additional products, time or services, the client will be informed where reasonably possible.

8. Client Nail Condition

Clients are responsible for providing accurate information about the current condition of their nails.

Before beginning a service, Nails By Mya Lily may determine that a particular service is unsuitable or needs to be modified based on the condition of the client's nails.

A service may be declined or changed where there is a reasonable concern that proceeding could be unsuitable for the client or the condition of their nails.

Clients should communicate any relevant allergies, sensitivities or previous reactions to nail products before their appointment.

9. Hygiene & Safety

Nails By Mya Lily aims to maintain appropriate hygiene and cleanliness throughout its services.

Clients are expected to follow reasonable hygiene and safety instructions during appointments.

Clients should inform Mya of any relevant allergies, sensitivities, skin conditions, nail concerns or previous reactions to nail products before treatment.

Nails By Mya Lily may decline to perform a service where it is reasonably considered inappropriate or unsafe to proceed.

10. Home-Based Business Rules

As Nails By Mya Lily operates from a home-based location, clients are expected to respect the home and surrounding property.

For the comfort and privacy of the household:

• A maximum of one additional person may accompany a client unless otherwise agreed.

• Smoking and vaping are not permitted inside the home.

• The home is not pet-free, and clients should be aware that pets may be present.

• Clients must behave respectfully and appropriately while attending an appointment.

• Clients must follow any reasonable instructions relating to safety, access and the home environment.

The full residential address may be provided to clients as appropriate for confirmed appointments and is not required to be publicly displayed on the website.

11. Children & Additional Guests

Clients should contact Nails By Mya Lily before bringing children or additional guests to an appointment.

Due to the home-based nature of the business and available space, only one additional person may accompany a client unless otherwise agreed.

Nails By Mya Lily reserves the right to request that additional guests do not attend where their presence would interfere with the appointment or the safety and comfort of those present.

12. Payments

Payment is required for services provided by Nails By Mya Lily.

Accepted payment methods may vary and will be communicated to the client where necessary.

Clients are responsible for paying the agreed amount for the service or products purchased.

Where a client requests additional services, designs or products, any additional costs will be communicated where reasonably possible before they are added.

13. Press-On Nails

Press-on nail sets are handmade and prepared according to the client's selected design, size and requirements.

Each standard press-on set includes:

• 10 handmade nails

• A mini buffer

• Nail glue

Clients are responsible for providing accurate sizing information where required.

Because press-on nails are handmade, minor variations between sets may occur. Every reasonable effort will be made to ensure the finished set matches the agreed design and specifications.

Care and application instructions should be followed to help maintain the condition and appearance of the nails.

14. Refunds, Returns & Consumer Rights

Nails By Mya Lily complies with applicable Australian Consumer Law.

Nothing in these Terms & Conditions removes or limits any consumer guarantee or other legal right that cannot legally be excluded.

If a service or product does not meet a consumer guarantee, the client may be entitled to a remedy depending on the circumstances.

Clients who believe there is a problem with a service or product should contact Nails By Mya Lily as soon as reasonably possible and explain the issue so it can be assessed and an appropriate solution can be considered.

Consumer guarantees are separate from any voluntary policy or warranty offered by a business and cannot simply be removed through a website policy or Terms & Conditions.

15. Client Satisfaction & Concerns

Nails By Mya Lily wants clients to be happy with their services.

If you are unhappy with any part of your appointment, please contact Mya as soon as reasonably possible.

Where a concern relates to the service provided, Nails By Mya Lily will consider the circumstances and work with the client to determine an appropriate solution, subject to the client's rights under Australian Consumer Law.

16. Changes to Appointments or Services

Nails By Mya Lily may occasionally need to change, postpone or cancel an appointment due to illness, emergencies, unforeseen circumstances or other reasonable reasons.

Where this occurs, reasonable efforts will be made to contact the affected client and arrange another suitable time.

If Nails By Mya Lily cannot provide a service that has already been paid for, the client will be provided with an appropriate solution in accordance with applicable consumer law.

Nails By Mya Lily aims to ensure that information displayed on its website, including prices, services, opening hours and descriptions, is accurate and up to date.

However, information may occasionally change or contain errors.

Nails By Mya Lily reserves the right to correct errors and update website information when necessary.

Nails By Mya Lily may photograph completed nail sets for its portfolio or social media.

Client photos will not be intentionally used in a way that identifies the client without appropriate permission.

If a client does not want their nails photographed or shared on social media, they should let Mya know before or during their appointment.

Clients may also choose to provide their own photographs or feedback for use on the Nails By Mya Lily website or social media, subject to permission.

19. Testimonials & Reviews

Nails By Mya Lily may display genuine client reviews or testimonials on its website or social media.

Reviews should represent genuine client experiences.

Nails By Mya Lily does not guarantee that every client's experience will be identical, as results may vary depending on the selected service, nail condition, design and individual circumstances.

20. Intellectual Property

The Nails By Mya Lily name, branding, logo, original website content, photographs and other original materials created for the business remain the property of Nails By Mya Lily or their respective owners unless otherwise stated.

Website content, photographs, branding and other materials must not be copied, reproduced or used commercially without permission.

Clients retain ownership of photographs or content they independently create and provide, unless otherwise agreed.
